Moffitt: Not a District 117 Resident

Information and clarification on North Carolina's laws concerning residency and candidacy.

Throughout this campaign, the question of Tim Moffitt's residency has been flagged by many people in the community. Because of this, my campaign manager began to look into these allegations. Here is what he found.
From 1992 to 2016, a span of 24 years, Moffitt was registered to vote in, voted in, and had his primary place of residence in Buncombe County.
In 2018, his address changed in his voter registration to 5016 Bearwallow Mountain Rd., Hendersonville, NC 28792 (“Henderson property”), a property in Henderson County within the borders of HD 117. Upon information and belief, Moffitt changed his address on paper but did not change his actual place of residence.
The Henderson property is formally owned by Bearwallow Mountain Ranch, LLC (the “LLC”), a real estate holdings company the principal address of which is 3182 Sweeten Creek Road, Asheville, NC 28803 (“Buncombe property”). This is a Buncombe County (HD 116) address well outside of the NC House district for which Moffitt is running.
Since summer 2017, the Henderson property has been permanently listed under Moffitt's name as a rental property on VRBO.com. Since we discovered this, Tim Moffitt has explained that he has a second house on the property.
The online Vrbo entry features at least 41 customer reviews, including as recently as August 2020. This clearly demonstrates that Moffitt does not currently use—nor does he intend to use—this property as his primary place of residence.
Perhaps most tellingly, when Moffitt filed his Notice of Candidacy in 2019, he stated the Buncombe property address (3182 Sweeten Creek Road, Asheville, NC) is his RESIDENTIAL address.
Moffitt is listed as living at the Buncombe property address on the candidate filing list produced by the North Carolina State Board of Elections (herein the “Board”).
The June 13, 2017 Articles of Organization for Bearwallow Mountain Ranch, LLC list this as Moffitt’s address. This address is also listed as the LLC’s registered mailing address. Upon information and belief, all 3 of Moffitt’s children are registered to vote at the Buncombe property.
On the first page of Moffitt’s Statement of Economic Interest, dated December 16, 2019, Moffitt indicated that he lives in the same house as his wife, Dina Moffitt. At that time, upon information and belief, she was registered as a resident of the Sweeten Creek household.
Although Moffitt’s wife is also now registered as living at the Henderson property, she voted in Buncombe County as recently as the June 23, 2020 second primary and only changed her voter registration to Henderson County on September 22, 2020.
Moffitt’s vehicles were registered in Buncombe County as of August of this year.
Based on these facts, it is clear that Moffitt does not use the Henderson County property as his PRIMARY PLACE OF RESIDENCE and in fact uses the Buncombe County property (HD 116) as his primary residence. Running for election in HD 117, Moffitt’s lack of primary residence in Henderson County is a direct violation of Article 2, Section 7 of the North Carolina Constitution, which states that each Representative must “reside in the district for which he is chosen for one year immediately preceding his election.”
